This application, for grant of anticipatory bail, arises out of Banka Police Station Case No. 479 of 2016, disclosing offences under Sections 147, 148, 149, 447, 341, 323, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. Considering the fact that the petitioners are named accused and case has been registered for the offence punishable under various sections of the Indian Penal Code including section 302 of the Indian Penal Code and that there is allegation against them of opening indiscriminate firing, I am not inclined to grant them privilege of anticipatory bail. I could not be persuaded by
Patna High Court Cr.Misc. No.36859 of 2016 (2) dt.19-09-2016 2/2 the submission made on behalf of the petitioners that only three injuries were found on the body of the deceased, though the allegation is against several persons including this petitioner is of opening fire.
This application is, accordingly, rejected.
However, it is observed that if petitioners appear before the learned court below within four weeks from today and seek regular bail, their application for regular bail shall be considered on its own merit without being prejudiced by this order. (Chakradhari Sharan Singh, J.) Amit/- U T
