The grievance of the petitioner in the present writ petition is non-payment of salary.

Mr. Umesh Kumar Mishra, counsel appearing on behalf of the petitioners submits that for redressal of his grievance he has represented before the District Programme Officer (Estb.), Siwan and as such he submits that this writ petition may be disposed of with direction to the District Programme Officer

Patna High Court CWJC No.17556 of 2017 (2) dt.19-01-2018 2/2 (Estb.), Siwan to take final decision on the claim of the petitioner for payment of salary.

In view of the above, the writ petition is disposed of with direction to respondent District Programme Officer (Estb.), Siwan to take final decision on the representation filed by the petitioner contained in Annexure-12 dated 26.9.2017 within a maximum period of sixty days from the date of receipt/production of a copy of this order.

It is made clear that this court has not expressed any opinion on the claim of the petitioner, it shall be the obligation of the respondent District Programme Officer (Estb.) to examine the record and pass appropriate order within the time frame indicted hereinabove and ensure payment of monetary benefit arisingout of such decision within a further period of one month. With the aforesaid, the writ petition stands disposed of in the light of the decision of the State Government issued by the Principal Secretary of the Education Department.
