JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 The petitioner seeks regular bail in connection with Rahika P.S. Case No. 126 of 2018, registered for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Prosecution case is that son of the informant was married with earlier married with one Kiran Devi and, thereafter, he also solemnized marriage with one Punam Devi and, thereafter, family members of the Kiran Devi and Punam Devi were threatening the son of informant and ultimately, he was killed and his dead body was found and the name of this petitioner transpired from the Call Details Record, in which, he was found constantly in touch Punam Kumari.

It has been submitted on behalf of the petitioner that he has been made accused int his case only on the basis of

Patna High Court CR. MISC. No.51605 of 2019(4) dt.20-11-2019 2/2 suspicion and except that there is nothing against the petitioner and he has been in judicial custody for almost one year. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the period of incarceration of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VIII, Madhubani, in connection with Rahika P.S. Case No. 126 of 2018 subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
