The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273 of the Indian Penal Code and Sections 30(a), 41 / 47 of the Bihar Prohibition and Excise Act.

As per the prosecution case, 188.280 liters of foreign liquor was recovered from a vehicle, of which, this petitioner was registered owner.

It is submitted on behalf of petitioner that without the consent or knowledge of petitioner, the vehicle in question was being used in transportation of illicit liquor. Petitioner has got clean antecedent.

However, learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.63904 of 2021(3) dt.01-07-2022 2/2 petition and submitted that huge quantity of illicit liquor has been recovered from the Scorpio vehicle, of which, this petitioner is registered owner.

Considering the fact that petitioner is registered owner of the vehicle, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
