JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2018 Petitioner apprehends his arrest in connection with Muffasil P.S.Case No. 161 of 2017 registered under Sections 307, 323, 325, 341, 379 and 448/34 of the Indian Penal Code. Allegation against the petitioner is of assault on the nose causing injury.

Submission of learned counsel for the petitioner is that there is land dispute between the parties from before and the injury is simple in nature.

Having heard both sides and in view of facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the

No.10729 of 2018 (2) dt.27-02-2018 2/2 like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Muffasil P.S.Case No. 161 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
