====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 08-09-2025 Learned counsel for the petitioners prays for and is allowed to implead the District Land Acquisition Officer, Gayajee as respondent no.7 in course of the day.
2. Heard learned counsel for the petitioners, the State as also learned counsel representing the Union of India.
3. The present petition has been preferred for the following relief/s:
(i) for issuance of a writ in the nature of
Patna High Court CWJC No.14165 of 2025(2) dt.08-09-2025 2/3 mandamus or a writ of mandamus or any other writ of the like nature thereby directing the respondent no.3 and 6 to record the private land of the petitioner recorded in Plot No.289 Revisional Survey Plot No.242 in Khata No.39 of Mauza Alinagar, Thana No.201 as private land the petitioners in any proceeding of acquisition of these plots of the land;
(ii) for issuance of a writ in the nature of mandamus or a writ of mandamus or any other writ of the like nature thereby directing the respondent authorities especially respondent no.3 to ensure that the private land of the petitioners recorded as Plot No.289 Revisional Survey Plot No.242 in Khata No.39 of Mauza Alinagar is not put forth in acquisition without adhering to the procedure prescribed for acquisition of private land;
(iii) for issuance of a writ in the nature of mandamus or a writ of mandamus or any
Patna High Court CWJC No.14165 of 2025(2) dt.08-09-2025 3/3 other writ of the like nature thereby directing the other respondents to ensure that proper compensation is paid to the petitioner for acquisition of the land of the petitioner;
(iv) for such other relief as this Hon'ble Court may deem appropriate in light of the facts of this case.
3. Learned counsel for the petitioners submit that he shall be approaching the newly added respondent no.7, the District Land Acquisition Officer, Gaya ji in next four weeks.
4. Learned counsel for the respondents submit that in that case, the matter shall be taken to its logical conclusion.
5. This Court, in that background, disposes of the writ petition allowing the writ petitioners to approach the respondent no.7, the District Land Acquisition Officer, Gaya ji in next four weeks who shall be taking the matter to its logical conclusion after hearing all the necessary parties by 31.03.2026.
