2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 302/201 of the Indian Penal Code.
3. As per the prosecution case, petitioner suspects that co-accused Ravish Kumar killed his son and threw the dead body by side of railway track with a view to conceal the offence.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. Petitioner's name has come in this case during course of investigation. However, none of the witness has stated that he saw the petitioner committing the offence. Co-accused, with
Patna High Court CR. MISC. No.56459 of 2024(6) dt.14-02-2025 2/2 similar allegation, has already been allowed pre-arrest bail by this Court vide order passed in Cr.Mis.No. 57282/2024. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 20.5.2024.
5. Learned counsel for the State and the informant oppose the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Gaya in Wazirganj Police Station Case No. 284 of 2024.
