The petitioner apprehends his arrest in Kudhani P.S. Case No. 152 of 2015 for the offences alleged under sections 366/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the learned court below that is Ist Additional Sessions Judge, Muzaffarpur has rejected the anticipatory bail petition of the petitioner with a direction that if the petitioner surrenders before the court below and the informant and victim appear and support whatever they have stated in the two petitions filed by them, the court below will consider the prayer for bail of the petitioner in the light of the same.

No.52376 of 2015 (2) dt.11-12-2015 2/2 It is therefore, directed that the petitioner should appear before Shri Anand Kumar Shrivastava ,the learned Judicial Magistrate Ist Class, Muzaffarpur in connection with Kudhani P.S. Case No. 152 of 2015 on 04.01.2016, the court below after examining the two petitions filed by the informant and the victim and after hearing the informant and victim in person, will consider the bail prayer of the petitioner. The petitioner is granted the privilege of provisional anticipatory bail for two months to be confirmed only on satisfaction of the learned court below.

With the aforesaid observation and direction the application stands disposed of.
