====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 120(B), 468, 471, 489(B), 489 (C) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 18.01.2022 and is a person with clean antecedent.

The informant alleges that on information a Swift Dzire car was apprehended along with four accused persons including the petitioner as from their possession fake currency notes of Rs. 500/- was recovered as detailed in the

Patna High Court CR. MISC. No.54090 of 2022(2) dt.04-01-2023 2/3 FIR near Indo-Nepal Border, further fake currency was also found stashed in the car.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that no fake currency note was recovered from his possession, it is also submitted that petitioner is neither the owner nor the driver of the vehicle, it is also submitted that from perusal of the seizure list it would manifest that no independent witness has signed the seizure list.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that the allegation against the petitioner is serious as it has been alleged that he was found carrying currency notes of Rs. 500/- and further fake currency was also found stashed in the car. Learned counsel next submits that such offences have the potency of destabilizing the economy. Considering the submission made by the learned A.P.P., the Court is not inclined to release the petitioner on bail.
