JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners are apprehending their arrest in a case registered for offences punishable under Sections 341, 323, 447, 448 and 324/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that only general and omnibus allegation of assault has been levelled against these petitioners and the specific allegation of assaulting one Prakash Sah, is against co-accused, namely, Tara Devi, who has already been granted the privilege of bail by Sessions Court itself. Learned counsel for the petitioners further submitted that the

Having heard both sides and in view of the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar learned Judicial Magistrate-01st Class, Jamui, in connection with Jhajha P.S. Case No. 103 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
