In this case, the petitioner is apprehending his arrest in connection with Alamganj P.S. Case No. 83 of 2018 corresponding to G.R. No. 809 of 2018 registered for offences under sections 419, 420/120B of the Indian Penal Code, Section 67 of the I.T. Act and Section 3(X) of the Bihar Examination Control Act, 1981 (under Sections 3 & 10 of the Bihar Conduct of Examination Act, 1981).

As per allegation made in the First Information Report, the petitioner was involved in supplying answer in the examination through Whatsapp.

Learned counsel for the petitioner submits that the petitioner is a teacher of that student as also he is an aspirant of

Patna High Court Cr.Misc. No.20257 of 2018(2) dt.20-04-2018 2/2 competitive examination and, thus, has no concern with the alleged examination. The petitioner has got no criminal antecedent.

Looking to the entire facts and circumstances of the case as also the nature of allegation, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Md. Noman Arshad alias Md. Arshad is rejected.
