Petitioner seeks bail in a case registered under Sections 379 of Indian Penal Code.

It is submitted by the petitioner's counsel that on basis of his own confessional statement, the petitioner has been implicated in this case. The petitioner has disclosed in this application that it is only upon his arrest in Phenhara Police Station Case No 25 of 2017 that he has been remanded in at least five other cases including the instant case. The recovery of the alleged motorcycle is not also from his possession and, as per prosecution case, from one Bhikhari Rai. Petitioner is in

Patna High Court CR. MISC. No.51884 of 2019(3) dt.30-09-2019 2/2 custody since 07.02.2018.

Having considered the submission, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in Trial No 2540 of 2018 arising out of Chhauradano (Mahuawa) Police Station Case No 6 of 2018 with the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
