The petitioner apprehends her arrest in Khodawandpur P.S. Case No.105/2017 registered under Sections 467, 468, 471, 420 and 120(B)/34 of the Indian Penal Code.

In pursuance of the order passed by this Court in C.W.J.C. No.15459 of 2014, an inquiry was held by the Vigilance Department with regard to appointment of Panchayat and Prakhand teachers, on the basis of forged and fabricated certificates. The petitioner is also made an accused on the allegation that she was Prakhand Pramukh at the time of appointment of Rinku Kumari.

Learned counsel for the petitioner submits that according to direction as contained in Annexure-2, the Block Development Officer and Block Education Extension Officer were entrusted to prepare the merit list of the candidates for appointment of teachers and it was the duty and responsibility of

No.12555 of 2018 (2) dt.28-02-2018 2/2 the Block Development Officer being the Secretary of the Selection Committee to prepare the merit list in accordance with law, after verifying all the documents of the candidates. The Prakhand Pramukh had no role to play in selection of any candidates. It is further submitted that Rinku Kumari is alleged to have been appointed on forged certificates but only Zero is left out at serial number of the certificate instead of 0113666 and on this ground, Rinku Kumari has already been granted anticipatory bail vide order dated 10.01.2018, passed in Cr. Misc. No. 58671 of 2017.

Considering the aforesaid facts, the petitioner above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Majhaul, Begusarai in connection with Khodawandpur P.S. Case No.105/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
