JUSTICE SUDHIR SINGH ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioners apprehend their arrest in connection with Aurangabad (Town) P.S. Case No. 319 of 2015 pending in the court of learned Chief Judicial Magistrate, Aurangabad for the offences instituted under Sections 304(B), 201 and 34 of the Indian Penal Code.
As per the prosecution case, it is a case of murder of the informant's married daughter by the accused persons due to non-fulfillment of demand of dowry.
It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioner no. 1
Patna High Court Cr.Misc. No.48913 of 2015 (3) dt.05-02-2016 2/2 is the father-in-law of the deceased and petitioner no. 2 is the mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. They have no concern with the affairs of the husband of the decease. They have been falsely implicated in the present case. . It is further submitted on behalf of the petitioner that from perusal of the medical prescription, it is evident that the deceased had died due to natural death.
On behalf of the State and informant, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Aurangabad (Town) P.S. Case No. 319 of 2015 on furnishing bail bond of Rs.10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
