The present application has been filed for modification of the order dated 13.07.2016 passed in Cr. Misc. No. 27253 of 2016 by which the petitioners were granted anticipatory bail in connection with Rail P.S. Darbhanga (SMI) Case No. 24 of 2016, pending in the court of learned Judicial Magistrate (Railway), 1st Class, Samastipur, under Sections 147, 148, 149, 323, 324, 325, 307, 353, 354, 393, 427, 364 and 365 of the Indian Penal Code and the petitioners were directed to surrender in the court below within a period of six weeks and furnish bail bonds but due to some unavoidable reason the petitioner no.7, namely Md. Irshad @ Irsad Pravej could not surrender in the court below well within time.

It is prayed on behalf of learned counsel for the

Patna High Court Cr.Misc. No.46089 of 2016 (2) dt.26-10-2016 2/2 petitioner that the period of surrender may be extended so that the petitioner could surrender in the court below and furnish bail bond.

Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of three weeks from the date of receipt/production of copy of the order. The order dated 13.07.2016 passed in Cr. Misc. No. 27253 of 2016, is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
