This application, for grant of anticipatory bail, arises out of Tekari P.S. Case No. 48 of 2014, disclosing offences under Sections 419 and 420 of the Indian Penal Code. Allegation against the petitioner is of having misappropriated wheat worth Rs.

14,32,342.70/-, while functioning as Block Statistics Officer-cum- In-charge Purchase Center, Tekari, Gaya.

Learned counsel for the petitioner, has submitted, taking a line of least resistance that the petitioner shall deposit the said amount within a period of six months from today without any

Patna High Court Cr.Misc. No.42400 of 2016 (3) dt.24-10-2016 2/2 prejudice to his rights and contentions before any proceedings, arising out of the said transaction. He has also submitted that the petitioner shall make himself available to the police or the Court, as and when required, for the purpose of investigation or trial. Considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional Chief Judicial Magistrate, Gaya, in connection with Tekari P.S. Case No. 48 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself/herself before the police/Court, as the case may be, as and when required and in the event of failure on his/her part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
