JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Special Case No. 6129 of 2017 arising out of Chowk P.S. Case No. 277 of 2017 registered for the offence punishable under sections 272, 273/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on the confessional statement of the co-accused. He has been implicated in this case merely on suspicion. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is from Hira Nand Ghat Bank of Ganga river. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner,

Patna High Court Cr.Misc. No.9526 of 2018(2) dt.20-02-2018 2/2 above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No. 6129 of 2017 arising out of Chowk P.S.
