The petitioner seeks bail in a case registered under Sections 420, 406, 379, 120(B)/34 of the Indian Penal Code. Prosecution case, in short, is that on 27.05.2019 the F.I.R. named accused persons along with three unknown persons came at the house of the informant and requested him to give his scorpio for going to Gaya. Informant told that driver is not available. Then Chandan Kumar has taken the key of scorpio vehicle on pretext of washing the same. Thereafter Chandan Kumar informed the informant that some miscreants have snatched the vehicle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.05.2019 and has got no

There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against co-accused, namely, Chandan Kumar. The petitioner had also accompanied said Chandan Kumar. Hence he has been made accused in the present case. Except for this, there is no other substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Delha P.S. case No.142 of 2019.
