The petitioners apprehend their arrest in Nauhatta P.S. Case No. 115/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. Vivek Kumar Raushan the informant alleged that the accused persons were filling earth on his land and when he went to protest Ahmad Khan @ Bachchu assaulted him with Farsa on his head and Amjad Khan assaulted him with butt of rifle on his wrist. Learned counsel for the petitioners submits that there is counter version being Nauhatta P.S. Case no. 116/2016. The informant and others assaulted the petitioners and others and there is dispute with regard to land between both the sides.
Patna High Court Cr.Misc. No.39942 of 2016 (3) dt.22-10-2016 2/2 Injuries found on the person of the informant are simple in nature.
Considering the facts aforesaid and the fact that there is case and counter case and the occurrence took place due to land dispute in which the informant received simple injuries, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.S. Case No. 115/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
