JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-12-2016 Heard the learned counsel for the petitioners and the learned A.P.P. representing the State.
The petitioners seek anticipatory bail in connection with Biddupur P.S. Case No. 169 of 2016 registered for the offences punishable under Sections 341, 323, 308, 354, 379 and 504 of the Indian Penal Code.
Allegedly, the petitioners assaulted the grandson of the informant causing injury on his head and when the informant asked the petitioners then they abused and got her down with bad intention by which the informant became necked and her gold Jitia was snatched.
Submission is of false implication and that there is
Patna High Court Cr.Misc. No.49958 of 2016 (2) dt.16-12-2016 2/2 a case and counter case, the occurrence is alleged to be of 13.06.2016, whereas case has been registered on 17.06.2016. The injuries caused to the grandson of the informant are all simple in nature caused by hard and blunt object vide Annexure-3. However, now, good sense has prevailed between the parties and both parties have compromised the case and filed the compromise petition in the court below, which is mentioned in the order-sheet of the learned Additional Sessions Judge-V, Vaishali at Hajipur.
Learned A.P.P. fairly submits that in view of the compromise, lenient view can be taken.
In the facts and circumstances stated above, the petitioners in case of their arrest or surrender before the court below within six weeks from the date of receipt / production of a copy of this order shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Biddupur P.S. Case No. 169 of 2016, subject to the conditions as laid down in Section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J) ajaypd./- U T
