The petitioner apprehends his arrest in a case registered for offences punishable under Sections 47A of the Bihar Excise Act.

It is alleged that from the house of the petitioner 35 liters of illicit liquor and 240 kg 'Jawa Mahua' were recovered. It has been submitted on behalf of the petitioner that case was lodged before the new amendment of Bihar Excise Act vide Bihar Excise (Amendment) Act, 2016 and the petitioner's antecedent is clean.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.37836 of 2016 (2) dt.17-09-2016 case, let the above named petitioner, be released on bail in the event of arrest/surrender before the Court below within a period of six weeks from today in G.O. Case No. 649 of 2014, on furnishing bail bond of Rs. 10,000/-(Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Nawada subject to the conditions as laid down under Section (2) of Section 438 of the Code of Criminal Procedure.
