Mr. Suresh Prasad Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365, 379, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 02.06.2022 and is a persons with clean antecedent and the informant alleges that petitioner along with Santosh came and stayed in his house in the night on 06.03.2022 and when he woke up at about 03:00 AM he found his wife missing and when he contacted Santosh he threatened him.

Learned counsel for the petitioner submits that

No.54214 of 2022(2) dt.04-01-2023 2/2 petitioner has been falsely implicated in the present case, it is next submitted that Santosh and wife of the informant were known to each other and she on her own volition had gone with him and later came back and her statement was recorded under Section 164 Cr.P.C., wherein she has not alleged anything against the petitioner.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by the learned counsel for the petitioner, the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahnar P.S. Case No. 59 of 2022.
