JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 353, 332 and 283 of the Indian Penal Code in connection with Mohania P.S. Case No. 576/2017.
Allegation as per the F.I.R. against the above named
Patna High Court Cr.Misc. No.28193 of 2018 (2) dt.17-05-2018 2/3 petitioners is that they along with large number of other accused persons came and made slogan against the police. When the police intervened them, they abused the police and made scuffle with the police personnel.
Submission of the learned counsel for the petitioners is that though they are named in the F.I.R. but no specific allegation has been attributed against them.
Heard learned Additional Public Prosecutor also. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabhua) in connection with Mohania P.S. Case No. 576/2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors should be close relative of the petitioners and another having sufficient immovable property within the jurisdiction of the court below and the petitioners will co-operate in disposal of the trial and will make themselves available before the court and failure to appear on two consecutive dates without any appropriate
