.... .... Respondents ====================================================== Appearance :

For the Petitioner/s : Mr. Dhannjay Kumar For the Respondent/s : AC to GA 10 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-02-2016 Heard Sri Dhananjay Kumar, learned counsel for the petitioner and learned A.C. to Govt. Advocate - 10. The petitioner, who admittedly superannuated w.e.f. 31st December, 2000, as an Assistant Teacher and thereafter, he received retiral benefit as Assistant Teacher, has filed the present writ petition in the year 2011, with a prayer to direct the respondents to treat him as B.A. trained not Matric trained teacher. Learned counsel for the petitioner tried to persuade the court that even after retirement the petitioner was given assurance that his case will be considered. However, there is no specific material on record to satisfy the court that any express assurance was given and it was denied.

Patna High Court CWJC No.3034 of 2011 (5) dt.08-02-2016 2/2 In view of the facts that the petitioner slumbered over his right for such a long time, the Court is of the opinion that after such a belated stage, his case may not be entertained. The writ petition stands dismissed.
