JUSTICE RAKESH KUMAR ORAL ORDER 29-01-2016 Heard Sri Sanjay Kumar Pandey, learned counsel, who was assisted by Sri Suresh Prasad Bhakta, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor. The petitioner, apprehending his arrest in connection with Vijaipur P.S. Case no.80/15 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that of course, in the F.I.R. the petitioner has been shown as main accused and gave blow spade on the informant, but during medical examination, the injury, as alleged in the F.I.R., was not corroborated. However, he does not dispute that there was no injury.
Patna High Court Cr.Misc. No.47498 of 2015 (3) dt.29-01-2016 2/2 In view of the fact that the petitioner is one of the main accused in the F.I.R., the Court considers that it is not a fit case for extending the privilege of anticipatory bail. The petition stands dismissed.
