ANJANA MISHRA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Sirdala P.S. Case No. 118 of 2016 for the offences registered under Sections 147, 148, 149, 341, 323, 307, 448 and 504 of the Indian Penal Code.

At the outset, learned counsel for the petitioners submits that petitioner no. 2 has been taken into custody and therefore, he seeks liberty to withdraw the application as against petitioner no. 1.

Liberty is granted.

Accordingly, the application as against petitioner no. 1

Patna High Court Cr.Misc. No.37649 of 2016 (3) dt.28-10-2016 is dismissed as withdrawn.

Learned counsel for the petitioners submits that there is general and omnibus allegation against all the accused persons whereas one Mukesh Rajbanshi is said to have assaulted the son of the informant leading to injuries. So far as the petitioner no. 3, namely, Karan Rajbanshi is concerned, there is no specific allegation against him of assaulting the informant or his family. Considering the facts and circumstances of the case and that petitioner has got no criminal antecedent, let the petitioner no. 3, namely, Karan Rajbanshi, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-V, Nawada in connection with Sirdala P.S. Case No. 118 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
