This application for anticipatory bail arises out of Town P.S. Case No. 883 of 2018 for the offence under Sections 341, 323, 325, 365, 379, 504 and 509/34 of the Indian Penal Code.
Considering the nature of allegation and the fact that petitioner has criminal antecedent inasmuch as he is accused of commission of offence under Section 302 of the Indian Penal Code, I am not inclined to entertain this application for grant of anticipatory bail. This application is accordingly rejected. The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on
Patna High Court CR. MISC. No.50003 of 2019(2) dt.09-08-2019 2/2 its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
