JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-02-2018 The petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. R-5356 of 2016 instituted for the offence under Section 420 of the Indian Penal Code.
It has been alleged by the complainant that the petitioners despite having taken Rs. 1,65,000/- from him for providing an appropriate Visa and job in a foreign country, only arranged for a tourist Visa. It has further been alleged in the complaint petition that on the asking of the petitioners, the complainant went to Bangkok where he learnt that he had come to that country on a tourist Visa. He was also made to understand that a hotel room was booked in his name. Perforce, he had to pay the hotel bills and had to come back to his own country after
Patna High Court Cr.Misc. No.4332 of 2018 (2) dt.01-02-2018 2/2 purchasing ticket from his own money.
Learned counsel for the petitioners has submitted that a false and concocted case has been lodged against the petitioners. There is no proof of the fact that petitioners have accepted Rs. 1,65,000/- from the complainant under any account. If the complainant agreed to accept a job and a work Visa from the petitioners, the complainant would have surely taken care to know as to for what work was he going to Bangkok.
For the facts stated above, the petitioners, above named are directed to be released on bail, in the event of their surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to their furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VII, Gopalganj in connection with Complaint Case No. R-5356 of 2016, Trial No. 468/17, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
