This application for regular bail arises out of Nautan P.S. Case No. 167 of 2020, disclosing offence punishable under Sections 304-B, 201/34 of the Indian Penal Code. Subsequently, Section 302 of the IPC was added.
The petitioner is father-in-law of the deceased. Initially, the FIR was registered alleging commission of offence punishable under Section 304-B of the Indian Penal Code with allegation that the marriage of the deceased with the petitioner's son was solemnized nearly seven years prior to the date of occurrence. However, subsequently, the charge-sheet has been submitted for the offence punishable under Section 302 of the
Patna High Court CR. MISC. No.63669 of 2021(2) dt.07-04-2022 2/2 IPC.
Learned counsel appearing on behalf of the petitioner has submitted that there is no specific allegation against the petitioner of having assaulted the deceased or made any demand for dowry. The petitioner has been implicated, he contends, only because he is the father-in-law of the deceased. Since the petitioner is in custody since 04.11.2020 and there is no specific allegation in the First Information Report of any overt act against him, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned C.J.M., Siwan, in Nautan P.S.
