ANJANA MISHRA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Sheosagar P.S. Case No.171 of 2015 for allegedly having committed the offence under Sections 341, 342, 323, 326, 307, 504, 506, 509, 379 and 148 of the Indian Penal Code.

Petitioner No.1 Nandu Sah and Petitioner No.2 Santosh Sah have been taken into custody and, therefore, this application, as against them, has become infructuous. It is, accordingly, dismissed as withdrawn.

No.48231 of 2015 (2) dt.14-01-2016 2/2 So far as the allegations against petitioner No.3 Gajju Sah and Petitioner No.4 Surendra Sah are concerned, the same are general and omnibus in nature and that the said petitioners have no criminal antecedents. It is further submitted that there is case and counter case between the parties, as a result of which Annexure 2, bearing Complaint Case No.853 of 2015, has been lodged.

Considering the aforementioned facts and circumstances, nature of allegations and also that the petitioners have no criminal antecedents, let petitioner No.3 Gajju Sah and Petitioner No.4 Surendra Sah, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sasaram (Rohtas), in connection with Sheosagar P.S. Case No.171 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
