Petitioner is apprehending her arrest in Sursand P.S. Case No. 168 of 2017 for the offences registered under Sections 304B, 201 and 34 of the Indian Penal Code.

It is alleged that daughter of informant was killed on account of non-fulfillment of demand of dowry by accused persons including petitioner.

It has been contended on behalf of the petitioner that she has falsely been implicated in the present case. She is mother-inlaw of the deceased. The witnesses examined have not supported the prosecution case. The case has been compromised between the parties. It is further submitted that similarly situated co-accused Ganesh Sah has been granted

Patna High Court Cr.Misc. No.2088 of 2018(3) dt.17-02-2018 2/2 anticipatory bail vide Cr. Misc. no. 55798 of 2017. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupari at Sitamarhi, in connection with Sursand P. S. Case No. 168 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
