2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.
3. It is alleged that petitioner No. 1 took Rs. 1,50,000/- (one lac fifty thousand) and petitioner No. 2 took Rs. 20,000/- (twenty thousand) from the informant and when the informant demanded her money, these petitioners refused to return the same.
4. It is submitted that petitioner No. 1 is full brother and petitioner No. 2 is cousin sister of the informant. As a

No.54159 of 2023(2) dt.21-08-2023 2/2 matter of fact, petitioner No. 1 gave Rs. 1,31,000/- (one lac thirty one thousand) to the informant on 17.07.2020 and Rs. 50,000/- (fifty thousand) on 10.09.2020 for the treatment of her husband. On 12.04.2022, Rs. 1,50,000/- (one lac fifty thousand) was returned to the petitioner No. 1 and on his recommendation Rs. 20,000/- (twenty thousand) was given to petitioner No. 2 and, as such, no offence as alleged in the F.I.R. has been committed. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (Muffasil) P. S. Case No. 263 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
