In this case, the petitioners are apprehending their arrest in connection with Shikarpur P.S. Case No. 500 of 2017 registered for offences under sections 147, 149, 342, 379, 354(4), 324, 506, 323 and 380 of the Indian Penal Code. As per First Information Report, the male members have caught hold the hair of the Informant and brought to Khaliyan where she was completely humiliated and assaulted by them and no one came forward to save her.
There is no specific allegation against the petitioner nos. 6, 7 & 8, namely, Sanjiro Devi, Gayatri Devi and
Patna High Court Cr.Misc. No.18889 of 2018(2) dt.06-04-2018 2/2 Kunti Devi who are female members.
Looking to the entire facts and circumstances of the case, let the petitioner nos. 6. Sanjiro Devi, 7. Gayatri Devi and 8. Kunti Devi, being lady, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Shikarpur P.S. Case No. 500 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. So far the male members i.e. petitioner nos. 1, 2, 3, 4 & 5 are concerned, this Court is not inclined to grant them privilege of anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioner nos. 1. Asesar Chaudhary, 2. Chchatri Chaudhary, 3. Jokhu Chaudhary, 4. Megha Chaudhary and 5. Manjesh Chaudhary is rejected with a direction to surrender before the court below and pray for regular bail.
