JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-08-2022 Though the present writ petition was filed for correction in the date of birth of the petitioner in the pension papers which had been inadvertently mentioned as 07.06.2000 instead of 20.09.2003, and accordingly direct the respondents to commence payment of family pension in favour of the petitioner but today the learned counsel appearing for the High Court has produced a letter written by the District & Sessions Judge, Lakhisarai dated 13th August, 2022 which is addressed to the Accountant General, Bihar, Patna wherein it has been certified

Patna High Court CWJC No.19032 of 2021(5) dt.25-08-2022 2/2 that the date of birth of the petitioner is 20.09.2003, hence this Court finds that now there is no impediment for the Accountant General to issue family pension payment order in favour of the petitioner.

Having regard to the facts and circumstances of the case, the Accountant General, Bihar, Patna is directed to ensure issuance of the necessary family pension payment order within a period of two weeks from today, whereupon the respondent Bank shall immediately pay the same within a period of two weeks thereafter and shall also ensure payment of family pension from month to month till the time, the petitioner is entitled for the same.

The writ petition stands disposed off on the aforesaid terms.
