Rajkishore Prasad and learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Belaganj P.S. Cae No. 145 of 2015 for offences alleged under sections 341, 324, 307, 337, 338, 379/34 of the Indian Penal Code.
The prosecution case in brief is that informant alleged on 14.08.2015 at about 9.30 A.M. all accused persons came and in order to grab the land of informant. When husband of informant protested then all accused persons having been armed with armed lathi, tangi, accused Ram Pravesh Pandey assaulted by Tangi on the head of husband of the
Patna High Court Cr.Misc. No.47946 of 2015 (2) dt.15-10-2015 2/2 informant and accused Munna Pandey, Bharat Pandey also assaulted to husband of the informant. Munna Pandey snatched chain of informant.
It has been submitted by the learned counsel for the petitioners that no specific overt act is alleged against the petitioners. It is alleged that all the three petitioners were involved in beating the informant. The injury report which has been placed at annexure-2 of this petition mentions the injury to be simple in nature. It has further been submitted by the learned counsel for the petitioners that they have clean antecedent. Be that as it may, let the above named petitioners in the event of their arrest or surrender before the court below within a period of six weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case no. 145 of 2015, subject to the conditions laid down under section 438(2) Cr.P.C.
