====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 13-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kishanganj P.S. Case No.473 of 2016 registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrte, Kishanganj.

The accusation is that on 12.10.2016 at about 06.00 A.M., an information was received on the mobile of the son of the informant to the effect that a Toto and a dead person is lying in the water near M.C.M. Bridge. Thereafter, the informant and his son went there and found the Toto lying in the water and the dead body of his son Suresh Das in the back portion of the Toto. Two cut injuries were found on the person of the deceased Suresh Das, the son of the informant. The

Patna High Court Cr.Misc. No.55734 of 2016 (2) dt.13-01-2017 2/2 informant raised suspicion against his villager Pinki Devi and her husband Yogen Sah having their hands in the murder of his son Suresh Das as Suresh Das had illicit relation with Pinki Devi, after the death of his wife.

Learned counsel appearing on behalf of the petitioners submits that in course of investigation, the name of the petitioners have come in the confessional statement of Pinki Devi, the sister of the petitioners, having their hands in the murder of Suresh Das. Except that, there is nothing against the petitioners to connect them in the commission of the alleged offence.

Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected. However, the petitioners are directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
