21-09-2016 Heard Sri Sanjay Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who at the relevant time was Panchayat Secretary, has approached this Court, with a prayer to grant anticipatory bail in Gayghat P.S. Case No. 218 of 2011, G.R. No. 3134 of 2011 registered for offence under Sections 467, 468, 406, 420, 471, 472, 34 of the Indian Penal Code. It was submitted by learned counsel for the petitioner that name of two beneficiaries was same, however; name of their husband was different and as such, error had occurred and instead of allotting the house to informant, who was B.P.L., it was allotted to one another Shail Devi. He further submits that similar error was committed in allowing son of other person to lift the rashan,
Patna High Court Cr.Misc. No.39145 of 2016 (2) dt.21-09-2016 2/2 which was to be lifted by the informant. He further submits that subsequently, the entire payment has already been made. After going through the F.I.R., which was lodged long back in the year 2011, the Court is satisfied that it is not a case for grant of anticipatory bail.
Dismissed.
