JUSTICE SATYAVRAT VERMA ORAL ORDER 11-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A and 494 of the Indian Penal Code.

The learned counsel for the petitioner at the outset submits that petitioner is willing to keep the informant with all dignity and honour.

The learned counsel for the information on instruction submits that even informant is willing to accompany the petitioner so that she can resume her conjugal life. The learned counsel for petitioner submits that on 17.07.2023 shall go to the parental home of the informant to bring her back to her matrimonial home.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Udwant Nagar P.S. Case No. 483 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, it is made clear that in the event if the petitioner breaches the undertaking given to this Court and does not go to bring the informant back on 17.07.2023 then in that event the informant shall be at liberty to file an application seeking cancellation of the anticipatory bail order granted to the petitioner.
