2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with G.R. No.666 of 2023 arising out of Jaynagar P.S. Case No.174 of 2023 registered under Sections 272, 273, 414 read with 34 of the Indian Penal Code, under Sections 30(a), 41 of the Bihar Prohibition and Excise Act, Sections 25(1-B)(a), 26 and 35 of the Arms Act.
3. Allegation against the petitioner is to engage in illegal trade/manufacturing of illicit liquor, where there is recovery of 1273.175 liters of IMFL/country-made liquor.

4. It is submitted by learned counsel that name of petitioner transpired on the basis of disclosure made by apprehended co-accused persons. It is submitted that admittedly no recovery was made form conscious physical possession of this petitioner, who is a man of clean antecedent.
5. Learned APP opposed the prayer for anticipatory bail to the petitioner.
6. In view of aforesaid factual submissions and by taking note of fact as recovery of illicit liquor prima facie appears doubtful from conscious physical possession of this petitioner, who is a man of clean antecedent, accordingly, the petitioner, above-named, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-II-cumExclusive Special Judge, Excise Act, Madhubani in connection with G.R. No.666 of 2023 arising out of Jaynagar P.S. Case
