JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with (Govt. Offical) P.R. Case No.69 of 2021 (Special Case No.5461 of 2021), instituted for the offences under Sections 30(a), 32(i), 32(iii), 41(i), 41(ii) of the Bihar Prohibition and Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 03.09.2021, he is a person with clean antecedent and prosecution report has been submitted in the case.
Allegation is of recovery of 320 litre of country-made liquor from the place near the house of the petitioner. The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.64194 of 2021(2) dt.04-02-2022 2/2 petitioner has been falsely implicated in this case as he was not aware, who had kept the liquor near his house. The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody since 03.09.2021, he is a person with clean antecedent and prosecution report has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with (Govt. Offical) P.R. Case No.69 of 2021 (Special Case No.5461 of 2021).
The application stands allowed.
