JUSTICE RAKESH KUMAR ORAL ORDER 29-01-2016 Heard Sri Rana Ishwar Chandra, learned counsel for the petitioner and Mr. M. Haque, learned Addl. Public Prosecutor. The petitioner, apprehending his arrest in connection with Patori P.S. Case no.183/2012 registered for the offence under Section 392 of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioners submits that the petitioner is not named in the F.I.R., however during investigation the petitioner's name has surfaced on the basis of confessional statement of one of the co-accused, who was arrested in another case. He further submits that it is a fit case for extending the privilege of anticipatory bail.
Learned Addl. Public Prosecutor has opposed the
Patna High Court Cr.Misc. No.47355 of 2015 (2) dt.29-01-2016 2/2 prayer for anticipatory bail. He submits that the petitioner is having criminal antecedent, as stated in paragraph-3 of the petition.
In view of facts and circumstances, I do not find any ground for extending the privilege of anticipatory bail. The petition stands dismissed.
