====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 21-12-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner is directed to remove the defect (s), as pointed out by the office, within a period of four weeks.

The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 297/2021 registered for the offence under Sections 147, 148, 149, 504, 341, 323, 307 of the I.P.C. and Section 27 of the Arms Act.

The prosecution case, in brief, is that on 22.12.2021 at

Patna High Court CR. MISC. No.54426 of 2022(2) dt.21-12-2022 2/3 about 9.00 A.M., the husband of the informant had gone to demand his due amount of Rs. 2,00,000/- from Aman Kumar. On which, Aman Kumar, Deepak Kumar (petitioner), Shiv Chandra Yadav, Bhuttu Kumar, Vikki Yadav and 8-10 unknown persons abused and assaulted her. She reached there alongwith her daughter aged about 4 years to save him then all accused persons started firing, which hit the leg of her daughter. Thereafter, they fled away on Motorcycle. The informant brought her daughter to Bakhtiyarpur Hospital for treatment. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.07.2022. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Nature of injury is said to be simple. No offence under Section 307 of the I.P.C. is attracted in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
