2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 144, 149, 341 , 342, 323 , 504, 325 , 379 and 308 of the Indian Penal Code.
3. As per the prosecution case , all the accused persons including these petitioners armed with lathi, dabia etc assaulted the informant causing several injuries to him.
4. It is submitted on behalf of the petitioners that the petitioners are innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.56969 of 2023(3) dt.06-12-2023 2/2 case. There is case and counter case for the same date of occurrence . As a matter of fact, due to pending land dispute between the parties a scuffle took place in which both sides sustained injuries. Though there is allegation of assault but there is no injury report on the record. Petitioners claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , I Supaul in connection with Triveniganj P.S. Case No. 215 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
