2. The petitioners apprehend their arrest in connection with Itadhi P.S. Case No. 150 of 2023 dated 17.06.2023 instituted under Sections 147, 149, 341, 323, 504, 506 and 308 of the Indian Penal Code.

3. As per the prosecution case, the accused persons including the petitioners came with arms at the house of the informant and started abusing and assaulting the informant and his family members. It is alleged that Saurav Yadav assaulted on the head of informant with Garasa, Brahmadeo Yadev assaulted on the hand of her husband with lathi causing fracture in finger.

4. Learned counsel for the petitioners submits that due to quarrel among the children, the fight took place between the parties in which both the parties have got injury. There is case and counter case between the parties. The injuries on injured are simple in nature except the injury on husband of the informant who sustained grievous injury on his left palm which is not on the vital part of his body. Learned counsel further submits that both the parties are co-villagers. The petitioners have no criminal antecedent.

5. Learned A.P.P. for the State assisted by learned counsel for the informant oppose the prayer for anticipatory bail of the petitioners.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks

No.57343 of 2023(2) dt.13-09-2023 3/3 from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Itadhi P.S. Case No. 150 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
