JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and learned counsel for the informant.

The petitioner apprehends his arrest in relation to Kanti P.S. Case No. 286/15, instituted under section 366 of the Indian Penal Code.

It is alleged that the petitioner while acting as a tutor to the daughter of the informant, enticed her away. It is further alleged that she was married, and as such the petitioner is alleged to have enticed away a married lady and had sexual intercourse, resulting in the lady became pregnant.

Learned counsel for the petitioner draws attention of this Court to the order of the learned Sessions Judge which shows

No.47368 of 2015 (2) dt.15-10-2015 2/2 that the girl was called to the court and where she had admitted that she had fallen in love with the petitioner, and she had accompanied him to Motihari and she became pregnant, but the petitioner did not agree to marry her. It is not disputed that the girl is not a manner.

Considering the aforesaid facts, I direct that in the event of arrest or surrender in the court below within four weeks, the above named petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Subdivisional Judicial Magistrate, West Muzaffarpur in connection with Kanti P.S. Case No. 286/15, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
