2.The petitioner is named in the F.I.R. and apprehending his arrest in connection with Begusarai Town P.S. Case No. 163 of 2025 registered for the offences punishable under Sections 103, 61(2) of B.N.S. and Section 27 of the Arms Act.
3. As per FIR, some unknown miscreants committed murder of one Ajit Mahto, a nearby resident of clinic of Dr. Prabhakar Thakur who is also one of the accused of this case.
4. It is submitted by learned counsel appearing on behalf of the petitioner that the name of this petitioner
Patna High Court CR. MISC. No.53129 of 2025(3) dt.31-10-2025 2/3 transpired on the basis of confessional statement of coaccused Chanchal Kumar whose name was also confessed by other co-accused persons. It is also submitted that even as per confessional statement allegation qua causing fatal fire arm injury is available against co-accused Prashant and Shivam. It is pointed out that despite of the claim of informant to identify the staff and assailant, no TIP was conducted till now. It is submitted that as far as effective investigation of this case is concerned, same appears already concluded and, therefore, sending this petitioner behind bar would not serve any purpose of justice. It is submitted that considering all such aspect coaccused Chanchal Kumar @ Chanchal Singh who confessed the name of this petitioner was granted regular bail by this Court through Cr. Misc. No. 51718 of 2025 dated 08.10.2025. While concluding arguments, it is submitted that above named petitioner is a man of clean antecedents.
5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as save and except suspicion arising out of confessional statement of co-accused nothing incriminating appears against this petitioner, whereas prima-facie on all material aspects the investigation of this case appears concluded, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai /concerned Court, where the case is pending in connection with Begusarai Town P.S. Case No. 163 of 2025, subject to the conditions as laid down under Section 482(2) of BNSS.
