1. Heard the parties.

2. The grievance of the petitioner, who claims to be the legally wedded wife of the respondent no. 3 is that the Central Bank of India has allowed the respondent no. 3 to make his second wife as nominee in the service book of respondent no. 3 maintained at the Central Bank of India, Samastipur.

3. Learned counsel for the petitioner submits that petitioner's marriage was performed with respondent no. 3 in the year 1983. There is family discord between the husband and the wife for which a case under Section 498A, Dowry Prohibition Act etc. has been filed.

4. Learned counsel for the petitioner submits that second wife cannot be declared as a nominee in the service book. As per legal provision adding the name of second wife in service book by the respondent no. 3 is against the provisions of law, service rules & conditions applicable in the Bank.

5. Mr. Ajit Kumar Sinha, learned counsel for the Bank submits that nomination of family members in the service book of a bank's employee is done as per the service rules applicable for the employees. On the basis of declaration given by the employee, nominee must have been added in the service book of the respondent no. 3.

6. Having heard learned counsel for the parties, it appears that there is dispute between husband and wife. The husband is an employee of Central Bank of India. The wife has grievance with regard to declaration of second wife having been registered as nominee in service book by the respondent no. 3.

7. In the circumstances, this Court directs the petitioner to file a representation before the Zonal Manager of the Central Bank of India or any other competent authority of the Central Bank of India in this regard within a period of fifteen days from today. If such a representation is filed, the concerned authority shall dispose the same in accordance with law by a reasoned

8. With the aforesaid observation and direction, this application is disposed of.
