In this case, the petitioner is seeking anticipatory bail in connection with Dhansoi P.S. Case No. 67 of 2019 registered for offence punishable under sections 30(A) of the Bihar Prohibition and Excise Act.
From a truck, vide Registration no. UP-14DT-4502, huge quantity of liquor has been recovered and the driver who has been arrested, has disclosed the name of this petitioner. The learned counsel for the petitioner submits that the petitioner is a co-villager of the driver and on account of enmity, the petitioner has falsely been implicated in the present case.
Looking to the facts and circumstances of the case,
Patna High Court CR. MISC. No.49545 of 2019(2) dt.08-08-2019 2/2 this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
