JUSTICE SUDHIR SINGH ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 448, 452, 323, 354, 380, 504 and 506/34 of the Indian Penal Code and 8/12/18 of POCSO Act. Allegation against petitioner is that he attempted to outrage modesty of the minor daughter of informant while other accused persons took away cash and ornaments. It is submitted on behalf of the petitioner that he has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. He has falsely been implicated in the present case. Petitioner and informant are neighbours. It is admitted land dispute between the parties. The alleged occurrence is said to have taken place on 12.8.2016 and a complaint case was filed on 18.8.2016. Delay has not been explained by the prosecution.

On behalf of the State, it is submitted that petitioner is named in the F.I.R./complaint.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender

Patna High Court Cr.Misc. No.50864 of 2016 (2) dt.29-11-2016 2/2 in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, in connection with Pupri P.S. Case no. 191 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
