JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner seeks bail in connection with Bhagwan Bazar P.S. Case No. 56 of 2016 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. Allegedly, the petitioner started assaulting the husband of the informant with bat and other co-accused were armed with wicket. During treatment the husband of the informant succumbed to the injury.

Submission is of false implication and that there is general and omnibus allegation against all the accused persons who have assaulted the deceased, post mortem report shows only one injury on the person of the deceased and as such the petitioner deserves sympathetic consideration as he is suffering in custody

Patna High Court Cr.Misc. No.12067 of 2017 (5) dt.29-06-2017 since 20.10.2016.

Learned APP duly assisted by learned counsel for the informant opposes the prayer of bail by submitting that the petitioner is the assailant as he has assaulted with bat. In the facts and circumstances stated above, considering the allegation attributed against the petitioner, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.
